Terms of Service

These Terms govern your use of BodyWHAT. By creating an account or using the service, you agree to them. Please read the disclaimers in section 4 carefully.

1. Acceptance of these Terms

By accessing or using BodyWHAT (the “Service”), operated by Bodywhat SAS, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use BodyWHAT. By using the Service you confirm that you are 18 or older and able to enter into these Terms.

3. The Service

BodyWHAT estimates body-composition metrics from photos you provide and offers AI coaching, training and nutrition plans, progress tracking and comparison tools. The metrics are estimates produced by statistical and machine-learning models; they are not laboratory or clinical measurements and will not be exact.

4. Not medical advice

BodyWHAT is a general fitness and informational tool. Its estimates, coaching, plans and any other output are not medical advice, a diagnosis, or a treatment plan, and are not a substitute for professional medical, nutritional or fitness advice. Always consult a qualified professional before starting a diet or exercise program or making health decisions, particularly if you are pregnant or have a medical condition. You use the Service and act on its output at your own risk.

5. Your account

You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for activity that happens under your account. Notify us promptly of any unauthorized use.

6. Your content

You keep ownership of the photos and information you upload (“Your Content”). You grant BodyWHAT a limited licence to store and process Your Content solely to operate and provide the Service to you — for example, to generate your metrics, coaching and comparisons. You confirm that Your Content is of yourself, that you have the right to upload it, and that it does not violate any law or third-party rights. Do not upload photos of other people without their consent.

7. Acceptable use

Fair use. Paid plans include generous usage that is effectively unlimited for normal personal use. To keep BodyWHAT fast and available for everyone, usage (including scans and AI coaching) is subject to reasonable daily limits and fair-use safeguards. We may throttle, limit, or suspend access in cases of excessive, automated, or abusive use, or use that degrades the Service for others.

8. Subscriptions, billing and auto-renewal

Some features require a paid membership. Current prices and billing periods are shown on the Premium page before you subscribe. Payments are processed by Stripe; by subscribing you authorize recurring charges.

9. Free trials

We may offer a free trial that requires a payment method on file. The trial converts into a paid subscription at the end of the trial period unless you cancel before it ends. Trial eligibility and length are shown when the trial is offered.

10. Refunds

Except where required by applicable law, payments are non-refundable, and cancelling stops future charges rather than refunding the current period. If you think you were charged in error, contact contact@bodywhat.com. Nothing here limits any statutory rights you may have as a consumer.

11. Returning and legacy users

If you had an account on a previous version of the product, your account and data may have been migrated so you can continue using the Service. These Terms apply to your continued use and supersede any terms you accepted on the prior version.

12. Intellectual property

The Service, including its software, design, models and content (other than Your Content), belongs to Bodywhat SAS and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal use under these Terms.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.

14. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind to the extent permitted by law. We do not warrant that estimates will be accurate, or that the Service will be uninterrupted or error-free.

15. Limitation of liability

To the maximum extent permitted by law, BodyWHAT will not be liable for indirect, incidental, special or consequential damages, or for loss arising from your reliance on the Service's estimates or coaching. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your statutory consumer rights.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the date above; your continued use after changes take effect constitutes acceptance.

17. Governing law

These Terms are governed by the laws of France, without regard to its conflict-of-laws rules. Where you use the Service as a consumer, you also benefit from any mandatory protections of the law of your country of residence.
